The following General Terms and Conditions (GTC) apply to all orders placed via our website.

A consumer is a natural or legal person who maintains business relations with thelorenzhuber that cannot be attributed to their commercial or independent professional activity. Orders in quantities not customary for households may be rejected without justification.

Arnold Kunsthandel reserves the right to amend these GTC at any time. The version of these GTC applicable at the time of the order shall be authoritative and cannot be unilaterally amended for this order. Any terms and conditions of the customer that conflict with or deviate from these GTC shall not be recognised. The operator of this website is Arnold Kunsthandel (Impressum)

3. Pricing

The sales prices stated on thelorenzhuber.com are final prices and, unless otherwise stated, include statutory VAT and any other statutory charges. The prices are quoted net in Swiss francs (CHF).

Unless otherwise stated, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the order process.

Certain Products are Price on Request, they can appear as CHF 0.00 in the shopping cart. Their price is not CHF 0.00, but as mentioned “price on request”, the painting can only be bought after an agreement is made via email.

Arnold Kunsthandel reserves the right to make technical changes, errors and misprints; in particular, Arnold Kunsthandel may change prices at any time without prior notice.

4. Conclusion of contract

The products and prices on this website are non-binding offers.

By placing an order via this website, the customer submits a legally binding offer to conclude a contract, including acceptance of these GTC. thelorenzhuber then sends an automatic order confirmation by email, which confirms that the customer's offer has been received by thelorenzhuber. Orders placed are binding for the customer. There is no right of return or cancellation.

The contract is concluded as soon as thelorenzhuber sends a declaration of acceptance by email, in which the receipt of the order is confirmed.

Orders will only be delivered after full payment has been received. If it turns out that the ordered goods cannot be delivered or cannot be delivered in full, thelorenzhuber is entitled to not accept or only partially accept or fulfil the order. In such a case, thelorenzhuber will inform the customer by e-mail or telephone. If the customer's payment has already been received by thelorenzhuber, the payment will be refunded to the customer. If no payment has yet been made, the customer shall be released from the obligation to pay.

5. Payment options and retention of title

The customer has the payment options specified in the order process at his disposal. The products delivered to the customer remain the property of thelorenzhuber until full payment has been made.

6. delivery, returns and warranty

Deliveries are sent by post or courier service to the address specified by the customer in the order. thelorenzhuber delivery times specified in the order confirmation or on the product pages are non-binding. thelorenzhuber is authorised to make partial deliveries. In this case, the customer will only be charged the shipping costs once.

If the delivery cannot be delivered or if the customer refuses to accept the delivery, thelorenzhuber may cancel the contract after notifying the customer by e-mail and granting a reasonable grace period, as well as charging the customer for the costs of the handling.

In principle, ordered items are excluded from return. thelorenzhuber endeavours to deliver goods in perfect quality. If the goods have been demonstrably damaged before receipt by the customer, thelorenzhuber will replace the purchased product (in the case of defects notified in good time within 14 days of receipt of the goods). The customer is obliged to inspect the delivered goods immediately upon receipt and to report any defects for which thelorenzhuber is liable without delay. In this case, the customer must contact thelorenzhuber (by e-mail or telephone)

It is at the discretion of thelorenzhuber to fulfil the warranty by repairing the product free of charge, replacing it with an equivalent product or refunding the purchase price. Further warranty rights are excluded.

The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties or defects attributable to external circumstances.

Original Paintings cannot be delivered as the transport via post represents a risk of damage. They need to be picked up in the Lorenz Huber Studio after an agreement for a pick-up date was made.

7. Liability

thelorenzhuber excludes all liability, irrespective of its legal basis, as well as claims for damages against thelorenzhuber and against any auxiliary persons and vicarious agents. thelorenzhuber is in particular not liable for indirect damages and consequential damages, loss of profit or other personal injury, property damage and pure financial loss suffered by the customer. Further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved.

thelorenzhuber only uses hyperlinks to simplify the customer's access to other websites. thelorenzhuber cannot know the content of these websites in detail, nor can it assume liability or other responsibility for the content of these websites.

It is not possible for thelorenzhuber to give any assurances or guarantees for the topicality, completeness and correctness of the data or for the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks and other content. In particular, no assurance or guarantee is given that the use of the website will not infringe the rights of third parties not owned by thelorenzhuber.

thelorenzhuber may process and use the data collected during the conclusion of the contract to fulfil the obligations arising from the purchase contract and for marketing purposes. The data necessary for the fulfilment of services may also be passed on to commissioned service partners (logistics partners) or other third parties.

In the event of disputes, Swiss substantive law shall apply exclusively, to the exclusion of conflict of laws provisions. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded. The place of jurisdiction is Lucerne.
